By accessing or using the website at gilroyasphaltpavingcompany.com (the "Site"), or by engaging Quickset Gilroy Asphalt Paving ("we," "us," or "our") for any service, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the Site or engage our services.
These terms apply to all visitors to the Site and to all customers who enter into a service agreement with us, whether in writing, by telephone, or by electronic communication.
Quickset Gilroy Asphalt Paving provides asphalt paving, sealcoating, repair, striping, drainage, and related services for residential and commercial properties in Gilroy, CA and surrounding service areas. The specific scope of work for each project is defined in a written estimate or service agreement provided before work begins.
We reserve the right to decline any project request at our discretion. Acceptance of a service request is confirmed only when we provide a written estimate and both parties agree to proceed.
All estimates are provided in writing and are based on conditions observed at the time of the site visit. Estimates are valid for 30 days from the date issued, unless otherwise stated. Material and labor prices are subject to change; if significant changes occur between the estimate date and the scheduled work date, we will notify you before proceeding.
Estimates do not include work that was not visible or disclosed at the time of the site visit. If hidden conditions are discovered during the project - such as failed base material, unmarked utilities, or damage beneath the existing surface - we will stop work and discuss the additional scope and cost with you before continuing.
Verbal estimates are not binding. Only written estimates signed or confirmed by both parties constitute a service agreement.
Project dates are scheduled based on crew availability, weather conditions, and material delivery. We will notify you of your confirmed start date as soon as it is set. You are responsible for ensuring the work area is clear and accessible on the scheduled date.
We may reschedule a project due to weather or other conditions outside our control without penalty. We will provide as much notice as possible in these situations.
If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours in advance. Cancellations with less than 48 hours notice may be subject to a rescheduling fee to cover crew mobilization costs already incurred. We reserve the right to charge for any materials ordered specifically for your project that cannot be returned.
Payment terms are stated in your written estimate. Unless otherwise agreed in writing, payment is due in full upon completion of the work. We accept payment by check, cash, or electronic transfer. We reserve the right to require a deposit on larger projects before scheduling.
Invoices not paid within 30 days of the due date may be subject to a late fee. We reserve the right to pursue collection of unpaid balances through any legally available means, including but not limited to filing a mechanics lien on the property where work was performed, as permitted under California law.
You are responsible for obtaining any permits, HOA approvals, or other authorizations required for the project before work begins, unless we have expressly agreed in writing to handle that on your behalf. We are not responsible for delays or costs resulting from your failure to obtain required approvals.
You agree to provide us with accurate information about the property and any known conditions - underground utilities, drainage issues, prior repairs, or structural concerns - that could affect the work. We are not responsible for damage to unmarked or undisclosed utilities or structures encountered during the project.
We stand behind our workmanship. If a defect in materials or installation arises from our work under normal use conditions, we will address it at no charge within the workmanship warranty period stated in your written service agreement.
Our workmanship warranty does not cover damage caused by: acts of nature (including flooding, earthquakes, or freeze events), vehicle or equipment damage, subsurface issues not disclosed at the time of the estimate, improper use of the surface, or normal wear and weathering.
The Site and all content on it are provided "as is" without any warranty of accuracy, completeness, or fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.
To the fullest extent permitted by applicable law, Quickset Gilroy Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our Site or services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of a service project shall not exceed the total amount you paid us for that specific project.
If a dispute arises between you and Quickset Gilroy Asphalt Paving relating to our services or these terms, both parties agree to first attempt to resolve it through good-faith direct communication. If direct resolution is not possible, disputes shall be resolved through binding arbitration in Gilroy, CA, under the rules of the American Arbitration Association, unless both parties agree otherwise in writing. Nothing in this section prevents either party from seeking emergency injunctive or equitable relief in a court of competent jurisdiction.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any legal action or proceeding not subject to the arbitration clause above shall be brought exclusively in the state or federal courts located in California.
We reserve the right to update these Terms and Conditions at any time. When we do, we will update the effective date at the top of this page. Continued use of the Site or our services after changes are posted constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
